The General Contractor, within the framework of this agreement, makes a guarantee deduction in the amount of 5 (five) percent of the cost of work specified in the local estimate calculation, to ensure that the Subcontractor fulfills its obligations under this agreement, including in terms of payment of penalties, fines and losses to cover possible costs of eliminating defects/losses that may arise in the course of Work performed by the Subcontractor, as well as compliance by the Subcontractor with the general deadline for the performance of Work under the Contract.
The guarantee deduction is carried out from each payment, in the amount of 5 (five) percent of the total amount of work performed for each accepted and payable Certificate of acceptance of work performed in the form of COP-2, Certificate of the cost of work performed and costs in the form of COP-3.
The warranty withholding is not carried out from the materials.
In case of deduction of a part of the amount of the guarantee deduction, including expenses incurred by the General Contractor to eliminate deficiencies in previously performed Works independently and/or with the involvement of third parties, as well as in case of violation by the Subcontractor of the terms of Work, the General Contractor transfers to the Subcontractor the remaining part of the amount of the guarantee deduction.
The refund of the amount of the guarantee deduction is carried out by the General Contractor within 30 (thirty) calendar days on the basis of the Subcontractor's invoice issued after 12 (twelve) months from the date of delivery of work under the Contract in full and the elimination of all identified deficiencies.
